Terms of Service

The service

AICinesLabs researches your market and creates marketing content for your brand, such as image posts and short video ads, and helps publish it. What each plan includes each month is listed on the pricing page.

Advertising budgets for Meta, Google or any other platform are not part of a subscription. You pay those platforms directly.

Eligibility and your account

AICinesLabs is a business service and is not intended for anyone under 18.

You sign in to AICinesLabs with your AICines account. You agree to keep your account information accurate and up to date, and you are responsible for activity under your account and for keeping your sign-in details secure. Tell us at once if you think your account has been misused.

YouTube API Services

If you connect a YouTube channel, AICinesLabs uses YouTube API Services to upload videos to that channel on your behalf and to read its performance data back to you. By connecting a YouTube channel, you also agree to the YouTube Terms of Service and acknowledge the Google Privacy Policy.

Plans and billing

Plans are billed monthly or yearly, in advance, through our payment processor Stripe. Yearly plans cost less than twelve monthly payments. Prices are shown in Indian rupees (INR) for customers in India and in US dollars (USD) everywhere else. Once your account has been billed in a currency, it stays in that currency.

Plans renew automatically at the end of each billing period until cancelled. For Indian cards and UPI, your bank or UPI app may notify you before each renewal, and may ask you to approve renewals above ₹15,000.

Prices do not include taxes unless stated. You are responsible for any taxes that apply to your purchase.

Changing your plan

• Upgrades start as soon as the new plan is paid for. Your previous plan then ends, and the unused part of it is added to your account as credit toward your future invoices.
• Downgrades take effect at the end of your current billing period. You keep your current plan until then and nothing is charged when you make the change.
• You can cancel a scheduled downgrade before it takes effect.

Cancellation and suspension

You can cancel anytime from Manage billing on the pricing page. Your plan stays active until the end of the period you have paid for and then ends. Refunds are covered by our Refund Policy.

We may suspend or end your access without prior notice if a payment fails and is not resolved, if you break these terms, if you try to circumvent the service's security, or if you open a new account to evade a suspension. You may ask us to delete your account at any time by emailing us; access ends immediately.

Your content

You keep ownership of the material you give us, such as your website, brand assets and product information. You give us permission to use it to provide the service to you.

Once your plan is paid for, the content we create for you is yours to use for your business. We may show it in our portfolio unless you ask us not to.

You confirm that you have the rights to the material you give us and that using it for your marketing does not infringe anyone else’s rights.

With your consent, the website and brand information you give us may be used in aggregated, de-identified form to improve AICinesLabs’ own features. It is never sold, and never used to train the underlying AI models generating your content. Email info@aicines.com to opt out at any time.

Acceptable use

You agree not to use AICinesLabs to:

• create content that is unlawful, misleading, hateful or infringes intellectual property
• promote products or services that are illegal where they are offered
• interfere with, overload or try to gain unauthorised access to the service
• resell or share access to the service without our written permission

AI-generated content

Much of the content is produced with AI tools. Review it before publishing: you are responsible for checking that claims about your products are accurate and that published content meets the rules of each platform you use.

Privacy

Your use of AICinesLabs is governed by our Privacy Policy, incorporated into these terms by reference. In short: we never sell your personal data, your website and brand information is shared only with the providers listed there to build your content, and if you connect a YouTube or Instagram channel we access only what is needed to publish and report on your behalf.

Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. Nothing in these terms limits your statutory rights under applicable consumer protection law, including the Indian Consumer Protection Act 2019 or applicable US state consumer laws.

Content is produced with the help of third-party AI providers and delivered using third-party infrastructure (Stripe for payments, Amazon Web Services for hosting). We are not the developer of those providers’ underlying technology and are not responsible for their outputs, availability, or changes to their own terms.

We do not guarantee any particular reach, views, sales or advertising results.

To the extent the law allows, AICines and its officers, directors and employees are not liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of the amount you paid us in the three months before the claim arose, or USD $100 (₹8,500).

You agree to indemnify AICines against claims, losses or expenses arising from your use of the service, the material you give us, or your breach of these terms.

Changes to the service

AICinesLabs is under active development and features may change. We will give at least 30 days' notice of a change that materially affects how an existing feature works, and at least 60 days' notice before discontinuing a feature you use, together with the option to export your data first. You can ask for an export of your data at any time by emailing info@aicines.com.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. This does not remove any mandatory consumer protection you have under Indian law (including the Consumer Protection Act 2019 and the Digital Personal Data Protection Act 2023) or under applicable US state law.

We encourage you to email info@aicines.com first to resolve a dispute informally. If that does not resolve it, disputes are settled by binding arbitration under AAA rules, or the equivalent in your jurisdiction, except that either side may go to court to seek an injunction over an intellectual property dispute.

You agree to bring any claim individually, not as part of a class, consolidated or representative action, except where the law in your jurisdiction does not allow that waiver.

General

• Entire agreement: these terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and AICines about AICinesLabs.
• Severability: if any provision of these terms is found unenforceable, the remaining provisions stay in full force.
• No waiver: our not enforcing a right on one occasion does not waive that right.
• Assignment: you may not assign your rights under these terms without our written consent. We may assign these terms as part of a merger or acquisition, with at least 30 days' notice to you.
• Force majeure: we are not liable for failures caused by events beyond our reasonable control, including infrastructure outages, AI provider disruptions, natural disasters or regulatory action.
• Language: these terms are in English. Any translation is for convenience only, and English controls in case of conflict.

Changes to these terms

We may update these terms. If a change materially affects you, we will tell you by email or in the service at least 30 days before it takes effect. Continuing to use AICinesLabs after that means you accept the updated terms.
